In a recent interview with Fox News, Justice Neil Gorsuch advised the Biden administration to “be careful” with its proposed reforms of the Supreme Court. Accountable.US calls out the irony of this warning, given the Court’s own recent controversies, including Justices Alito and Thomas’s billionaire-backed trips and Alito’s “Appeal to Heaven” flag. Far from careful, the justices have been careless in fueling perceptions of bias and corruption and, as consequence, have forced President Biden to act.

The Supreme Court's lack of accountability and transparency has eroded public trust. Gorsuch’s claim that reforms would undermine judicial independence overlooks the fact that the Court, under its current composition, has repeatedly acted in ways that compromise this very principle. Due to the court’s inaction to address the erosion of trust, the Biden administration is proposing necessary reforms so the judiciary serves the interests of all Americans, not just a privileged few. It would be careless to do nothing."

Accountable US President Caroline Ciccone

In the interview, Gorsuch emphasized the importance of an “independent” judiciary, seeming to suggest that President Biden’s proposed reforms—which includes a binding ethics code—could undermine this principle. However, the proposed reforms are designed to restore the integrity and independence of the judiciary after it has been compromised by partisan influences.

Justices Barrett, Kavanaugh, and Gorsuch were nominated after Leonard Leo, an unelected activist, helped compile a list of acceptable nominees for President Trump, aligning the Court with Leo’s fringe right-wing political ideology. In practice, the conservative majority on the court has repeatedly disregarded stare decisis, another tenet of the American judiciary, and overturned long-standing precedents such as Roe v. Wade and Chevron deference. Additionally, the Court has entertained cases brought by right-wing special interests tied to the network that installed the conservative majority. Notable cases include the mifepristone case and the billionaire bailout case, both connected to Leonard Leo.

Leonard Leo has been a pivotal figure in the conservative legal movement, using his influence to secure a conservative majority on the Supreme Court. He has been instrumental in pushing for the appointment of justices who align with right-wing ideologies, often supported by substantial funding from dark money networks. This influence has led to decisions favoring corporate interests and undermining protections for marginalized groups. Leo’s network, including groups like the Judicial Crisis Network, has invested millions to shape the judiciary, opposing any reforms that could introduce more accountability or limit the power of these appointed justices. Accountable.US has consistently advocated for reforms that enhance transparency and accountability within the judiciary and has continually sounded the alarm on Leo’s decades of judicial influence peddling.
