Leonard Leo-Connected Honest Elections Project Behind Pennsylvania Supreme Court Decision Throwing Out Mail Ballots
(Washington, D.C.) – Just days away from the midterms, the Pennsylvania Supreme Court has ruled that mail-in ballots lacking a date will not be counted, potentially throwing out numerous votes in a state that could determine control of the next Congress. Hundreds of thousands of Pennsylvanians have already voted by mail. This decision represents another win for right-wing activists looking to restrict voting rights and cast doubt on the results of the midterm elections.
Since 2020, Leonard Leo’s 85 Fund has operated as the “Honest Elections Project,” spreading disinformation ahead of the 2020 election and working to roll back voting rights nationwide. It has been actively engaged in the mail-in ballot fight in Pennsylvania and filed an amicus brief calling for ballots to be thrown out.

As the Honest Elections Project looks to further restrict voting rights, it’s also working to open another pathway to election subversion in 2024. In September, the group filed an amicus brief with the Supreme Court in Moore v. Harper supporting the fringe independent state legislature theory. This theory would give total control over federal elections to highly partisan state legislatures, rolling back voting rights protections and overturning Congressional maps created by bipartisan independent commissions.
