Industry Judge Shopping Crisis Spotlighted in Ad Outside WH Correspondents’ Dinner
WASHINGTON, DC — Outside of the White House Correspondents’ Dinner last night, government watchdog Accountable.US projected a new digital ad with the message, “Texas decisions, national consequences: Find out how the US Chamber of Commerce picks judges and how Texas court rulings affect all of us, no matter where you are,” calling out the Fifth Circuit Court of Appeal’s complicity in industry judge shopping from the likes of the U.S. Chamber, PhRMA, and other big industry groups. The ad directs viewers to https://accountable.us/5thCircuit for information about the worsening venue shopping crisis that often comes at the expense of everyday Americans.
When the Biden administration rolls out new actions to protect workers and consumers, big corporate interests frequently run to Texas federal courts for bailouts that have consequences for everyday Americans across the country. CEOs almost always receive a warm reception in Fifth Circuit territory in their cases for protecting profits under predatory and greedy practices. Industry’s venue shopping strategy is an undeniable power grab, yet the Fifth Circuit has been a willing partner to it over and over. It’s why Congress must act on judicial ethics reform now.”

Accountable.US recently released a new analysis finding that since January 2017, 63 percent of the U.S. Chamber’s lawsuits challenging federal regulations were filed within district courts under the jurisdiction of the Fifth Circuit — including its active lawsuit seeking to block the Biden administration’s new final rule capping most credit card late fees at $8 and its new filing to block the Federal Trade Commission’s (FTC) ban on non-compete contracts.
