Known hate group rails against abortion, contraception in nearly dozen lawsuits

WASHINGTON, DC – All eyes are on the Supreme Court as it considers whether to take up the high-stakes legal challenge to the widely-used abortion pill mifepristone. The case was initially brought and backed by Alliance Defending Freedom, a known hate group infamous for bankrolling anti-democratic, anti-LGBTQ organizations in favor of a radical agenda.

A new States Newsroom roundup found that Alliance Defending Freedom’s current slate of lawsuits is stacked with nearly a dozen challenges to abortion and contraceptive access — highlighting its continued anti-abortion crusade.

Alliance Defending Freedom is a key player in the far-right legal movement using the courts to force a dangerous, unpopular agenda on everyday Americans. These groups concoct cases — sometimes even based on sham scenarios — to force up to the Supreme Court, knowing they’re likely to deliver radical outcomes in their favor. From abolishing access to critical abortion care to enabling anti-LGBTQ discrimination, Alliance Defending Freedom’s ultimate goal is to use litigation to strip Americans of their rights and undermine democracy.”

Alliance Defending Freedom is behind nearly a dozen anti-abortion and anti-contraception lawsuits, including:

  • Alliance for Hippocratic Medicine v. U.S. Food and Drug Administration, the closely-watched legal challenge to the popular abortion pill mifepristone.
  • Idaho v. United States, a case challenging the federal Emergency Medical Treatment and Labor Act (EMTALA) requiring emergency medical providers to give stabilizing medical treatment to patients that might result in the termination of their pregnancies.
  • Texas v. Xavier Becerra, a case challenging EMTALA on behalf of Texas, currently under consideration at the far-right 5th Circuit Court of Appeals. ADF represents the state, arguing that requiring emergency rooms to treat pregnancy emergencies will “turn ERs into abortion facilities.”

Alliance Defending Freedom is well-known for shepherding numerous extreme cases to the Supreme Court. ADF helped overturn Roe, and was behind the recent Supreme Court case 303 Creative LLC v. Elenis, which undid decades of civil rights protections for LGBTQ Americans. The group also used a massive influx in funding to bankroll extremist anti-democratic organizations including the Child & Parental Rights Campaign, the Family Foundation of Virginia, and the Ethics and Public Policy Center.
