Accountable.US Condemns Judge Matthew Kacsmaryk For Allowing Republican States To Judge Shop Abortion Pill Lawsuit

Washington, D.C. — Today, in response to reports that Texas-based Judge Matthew Kacsmaryk will allow Missouri, Idaho, and Kansas to move ahead with their lawsuit seeking to restrict access to the abortion pill mifepristone, Accountable.US President Caroline Ciccone released the following statement condemning the brazen use of judge shopping to intimidate and manipulate the judicial system:
“This lawsuit highlights just how broken our judicial system has become, with judge shopping on the Fifth Circuit reaching a dangerous new low. It’s appalling that Missouri, Idaho, and Kansas are attempting to litigate their lawsuit in Texas—a state that is not a party in this case. This blatant manipulation of the courts underscores a system that enables ideologically-driven plaintiffs to bypass fair and impartial justice in favor of handpicked judges who align with their extreme agenda.
“The fact that Judge Kacsmaryk, a Trump appointee, is allowing these states to exploit this broken system to further restrict reproductive rights is an attack on access to safe, effective medical care for millions of Americans. This kind of judicial abuse does not serve justice; it only benefits special interests determined to roll back hard-won rights and freedoms.
“The American people deserve better. The judiciary should operate fairly and impartially—not be rigged to cater to political and partisan goals.”
The lawsuit, which seeks to roll back FDA regulations that expanded access to the abortion pill through telemedicine and mail delivery, was strategically filed in Texas despite the plaintiff states having no ties to the jurisdiction. The U.S. Court of Appeals for the Fifth Circuit has become a favorite venue for conservative plaintiffs because of its track record of issuing rulings that align with far-right political goals, making it a hotbed for judge shopping.
